Acceptable Use Policy

This Acceptable Use Policy (“AUP”) sets out the rules that apply to any party (“you”, “your”, “the Customer”) using the software, mobile applications, ERP/POS/CRM solutions and consulting and digital transformation services provided by My Partner ISC (Information Systems & Consulting) or one of its partners (the “Services”), and to any user of the Services, including through products or services provided by the Customer (an “End User”). The company is referred to as “My Partner ISC” in this AUP. The prohibited conduct listed below is not exhaustive. The Customer is responsible for its End Users’ compliance with this AUP. If the Customer or any of its End Users violates this AUP, My Partner ISC may suspend or terminate the Customer’s use of the Services. My Partner ISC may update this AUP from time to time, with reasonable notice that may be given through the Customer’s account, by email or by publishing an updated version of this AUP on the My Partner ISC website.

1. No Inappropriate Content or Users

Do not use the Services to transmit or store any content or communication (commercial or otherwise) that is illegal, harmful, unwanted, inappropriate or objectionable, including, without limitation, any content or communication that My Partner ISC determines (a) is false or inaccurate; (b) is hateful or encourages hatred or violence against individuals or groups; (c) could endanger public safety; (d) is pornographic, sexually explicit or not age appropriate; or (e) glorifies or incites violence. This prohibition extends to use of the Services by a hate group or by persons who have not reached the minimum age required by applicable law. The Customer and its End Users are also prohibited from using the Services to promote, or enable the transmission of or access to, any prohibited content or communication described in this section.

2. Prohibited Activities

Do not use the Services to engage in, or encourage, any activity that is illegal, deceptive, harmful, infringes the rights of others, or is detrimental to the business or reputation of My Partner ISC, including:

Violations of laws or standards. Violating laws, regulations, administrative decisions, industry standards or telecommunications carrier requirements in any applicable jurisdiction, including any provision requiring (a) prior consent to be obtained for the transmission, recording, collection or monitoring of data or communications, or (b) compliance with opt out requests relating to data or communications.

Interference with the Services. Interfering with, or otherwise adversely affecting, any aspect of the Services or any third party network connected to the Services.

Reverse engineering. Reverse engineering, copying, disassembling or decompiling the Services or the software published by My Partner ISC.

Falsifying identity or origin. Creating a false identity or making any attempt to mislead others as to the identity of the sender or the origin of any data or communications.

Fraudulent activities. Engaging in deception, fraud, misrepresentation or impersonation in any form, including Ponzi schemes, pyramid schemes or other fraudulent financial activities.

Spam and unsolicited communications. Sending bulk email, spam or unsolicited commercial communications.

3. Intellectual Property

Do not use the Services to infringe copyrights, trademarks, patents or other intellectual property rights, including by distributing unauthorized software, media or other content, violating license agreements or terms of use for third party content, or engaging in unauthorized scraping or harvesting of protected content. The software and applications published by My Partner ISC remain the exclusive property of My Partner ISC and may only be used in accordance with the applicable license or service agreement.

4. Financial and Cryptocurrency Restrictions

Do not use the Services for money laundering or other financial crimes, fraud or embezzlement, unauthorized cryptocurrency mining or trading, or transactions involving illegal goods or services.

5. No Harm to the Integrity of the Services

Do not compromise the integrity of the Services, including:

Circumventing Service limitations. Attempting to bypass, exploit, defeat or disable limitations or restrictions applied to the Services.

Security vulnerabilities. Probing for security vulnerabilities in order to exploit the Services, or attempting to bypass any security mechanism or filtering capability.

Disabling the Services. Any denial of service (DoS) attack against the Services or any other conduct intended to disrupt, disable or overload the Services.

Malicious code or bots. Transmitting code, files, scripts, agents or programs intended to cause harm, including viruses or malware, or using automated means, such as bots, to access or use the Services.

Unauthorized access. Attempting to gain unauthorized access to the Services.

6. Systems and Access Integrity

Do not misuse the information systems, application environments or access resources provided by My Partner ISC, including:

Usage manipulation. Artificially manipulating request volumes, usage patterns or application access methods in a manner inconsistent with normal use or intended to circumvent usage limits or usage related fees.

Access and credential abuse. Using, sharing or propagating credentials, access tokens or usage rights that the Customer is not authorized to use, or attempting to intercept, redirect or disrupt data exchanges between applications and their legitimate users.

Unauthorized interconnections. Attempting to establish or exploit connections, integrations or interfaces with the applications or infrastructure of My Partner ISC, or with those of its partners, without express authorization.

Resource exhaustion. Consuming technical resources, including processing capacity, storage or bandwidth, in a manner that has a disproportionate impact on other customers or degrades shared infrastructure.

7. Data Protection

It is the Customer’s responsibility to determine whether the Services offer appropriate safeguards for its use, including, without limitation, any safeguards required by applicable law or regulation, before transmitting or processing, or allowing its End Users to transmit or process, any data or communications through the Services. The Customer must comply with all applicable laws and regulations on the protection of personal data, in particular Tunisian Organic Law No. 2004-63 of July 27, 2004 on the protection of personal data and the decisions of the National Authority for the Protection of Personal Data (INPDP), including by obtaining the required consent before collecting, processing or transmitting personal data, and by honoring opt out requests and the rights of data subjects. For customers established in the European Union, the Customer remains responsible for compliance with the General Data Protection Regulation (GDPR, Regulation (EU) 2016/679) where it applies to its processing.

8. Appeals Process

If the Customer believes that an enforcement action was taken in error, it may submit an appeal to dev@mypartner-isc.com within 30 days of the action. The appeal must include a detailed explanation of why the action is believed to be unjustified, supporting documents or evidence, and the proposed corrective measures. My Partner ISC will review appeals in good faith, while retaining final discretion over all enforcement decisions.

9. Service Specific Requirements

Additional requirements may apply to certain specific Services, engagements or deliverables, as well as to products and services purchased from My Partner ISC but provided or made available by a third party. Where applicable, these requirements are set out in the relevant license or service agreement and apply only to the extent the Customer uses those Services or third party products and services. Where applicable, amounts due for the Services are stated in Tunisian dinars (TND) and are exclusive of Tunisian VAT at the rate in force.

10. Reporting Violations

Any violation of this AUP, including any prohibited content or communication, may be reported to contact@mypartner-isc.com or by phone at +216 52 888 866. Reports should include a description of the violation, any relevant evidence or supporting documents, and contact details for follow up. The Customer undertakes to report any violation of this AUP to My Partner ISC immediately and to cooperate, at the request of My Partner ISC, in investigating and/or remedying that violation.

11. Governing Law and Jurisdiction

This AUP is governed by Tunisian law. Any dispute relating to its validity, interpretation or performance that cannot be resolved amicably falls under the exclusive jurisdiction of the competent courts of Sfax, Tunisia.
