Country Specific Terms

These Country Specific Terms supplement the general terms and conditions of My Partner ISC and set out the additional requirements applicable to certain services (software publishing, mobile applications, ERP/POS/CRM solutions, consulting and digital transformation), to third party products and services made available as part of our services, and to regulatory obligations specific to each country. In the event of any conflict between these terms and the general terms and conditions, these terms prevail with respect to the country or service concerned.

1. Publisher and Contact Details

The services are provided by My Partner ISC (Information Systems & Consulting), a software publisher and IT consulting company incorporated under Tunisian law, founded in 2023 and based in Sfax, Tunisia.

2. Scope

These terms apply to any individual or legal entity (the “Customer”) using the software, applications, solutions and consulting services of My Partner ISC. They do not cover the provision of cloud hosting services or legal services, which are activities My Partner ISC does not carry out.

3. Governing Law and Jurisdiction

These terms, and all contractual relations between My Partner ISC and the Customer, are governed by Tunisian law.

Any dispute relating to their formation, interpretation, performance or termination that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the competent courts of Sfax, Tunisia, unless mandatory provisions to the contrary apply to a consumer Customer in their country of residence.

4. Prices, Currency and Taxation

Unless otherwise stated in a quote or purchase order, prices for software, licenses and services are stated in Tunisian dinars (TND).

Prices are exclusive of taxes. Applicable Tunisian value added tax (VAT), and any other legally due tax, withholding or levy, is added at the rate in force on the invoice date. For Customers established outside Tunisia, any taxes, duties and formalities applicable in their country remain their responsibility, in accordance with local regulations.

5. Personal Data Protection

5.1 Tunisian framework

My Partner ISC processes personal data in compliance with Organic Law No. 2004-63 of July 27, 2004 on the protection of personal data and its implementing regulations, under the supervision of the National Authority for the Protection of Personal Data (INPDP).

Accordingly, My Partner ISC undertakes in particular to:

  • collect data only for specified, explicit and legitimate purposes;
  • process only the data strictly necessary to perform the services;
  • implement appropriate technical and organizational measures to ensure the security and confidentiality of data;
  • complete, where applicable, the prior formalities (declaration or authorization) required by the INPDP;
  • guarantee data subjects the exercise of their rights of access, rectification and objection under the conditions provided by law.

5.2 European Union customers

Where the Customer is established in the European Union or the processing falls within the scope of Regulation (EU) 2016/679 (GDPR), My Partner ISC applies, for the processing concerned, the corresponding principles and obligations, in addition to the Tunisian framework.

6. Third Party Products and Services

Certain services may incorporate or provide access to products, software or services supplied by third parties (publishers, component suppliers, technical service providers). The use of these items may be subject to the specific terms and licenses of their suppliers, which the Customer undertakes to comply with. My Partner ISC shall not be liable for failures attributable to these third parties or for any non compliant use of their products by the Customer.

7. Country Specific Requirements
